Simba Arati slapped with a demanding letter after defaming Ruto’s allied politician in Kisii!

Kisii County Governor Simba Arati has been issued a three-day ultimatum following allegations of making defamatory remarks against an MCA.

In a demand letter obtained by Kenyans.co.ke, Rigoma MCA Nyambega Gisesa has called upon the governor to retract his statements and issue an apology within the specified timeframe, or risk facing legal repercussions.

The MCA alleges that during an address to boda boda riders on April 5, Governor Arati made malicious comments linking residents to him, thereby tarnishing his reputation.

“As you delivered that speech, people were heard shouting from the crowd “Nyambega Gisesa” whenever you referred to the MCA from Nyamira, and you did not do anything to dissuade them, in essence implicitly agreeing with them,” read part of the letter.

In his address, Arati mentioned that an MCA from Nyamira was allegedly provoking residents of Keroka Town to engage in conflict over an ongoing boundary dispute.

Although the Governor did not explicitly name Gisesa, the residents inferred it was him, prompting the issuance of the demand letter.

In the correspondence, Gisesa’s legal representatives have accused Arati of portraying the MCA in a negative light, insinuating that he is adulterous, unfaithful, involved in criminal activities, corrupt, and exploitative.

Furthermore, during a speech in Nairobi on March 16, Arati allegedly asserted that Gisesa was actively fueling violence in Keroka.

“You are the Governor of Kisii and your words have a greater impact than those of ordinary citizens, hence the damage to our client’s reputation has been extensive,” read part of the letter.

In response to the demand letter, Arati is obligated to retract his accusations by publishing a formal apology in two nationally circulated newspapers. Additionally, he must explicitly acknowledge the defamation of the MCA.

Furthermore, Arati has been instructed to refrain from disseminating any additional defamatory remarks, whether explicit or implied, against Gisesa.

“Take note that should the conditions above not be met within three days, our strict instructions are to institute appropriate proceedings against you for recovery of damages and other reliefs with no further reference to you, and at your own risk as to costs and incidentals thereto,” read part of the letter.

It’s worth noting that Gisesa had previously initiated legal proceedings against Kisii County regarding the collection of taxes from Keroka Town.

He contends that Keroka Town falls within Rigoma Ward in Nyamira County. This dispute arose despite a court ruling that barred the first-term governor and any of his administration’s officers from collecting revenue from the area. More
